Mr. Orenstein is a member of the firm and practices in the Mass Torts and Industry-Wide Litigation and Insurance Litigation and Product Liability Defense Practice Groups. Mr. Orenstein is an experienced trial attorney who focuses his legal practice primarily in the areas of complex torts and toxic tort litigation, products liability and general commercial litigation. Mr. Orenstein has litigated and tried cases in defense of municipalities and product manufacturers in courtrooms across New York state. He represents financial institutions and borrowers in commercial litigation and a large chain retailer in a variety of litigation matters. He oversees the preparation of cases for trial, including the cultivation of expert witnesses and the litigation of complex Frye and Daubert issues.
Prior to joining Harris Beach, Mr. Orenstein was a Senior Counsel and trial attorney for the City of New York Law Department, Office of the Corporation Counsel where he handled litigation in high exposure tort claims against the City of New York. He has extensive trial experience in defense of matters including premises liability, roadway design litigation, excessive force claims and other complex actions brought against a wide spectrum of New York City agencies, including the Department of Housing Preservation and Development, Health and Hospitals Corporation, Board of Education, New York City Police Department and Fire Department of the City of New York. He has published a Harris Beach Legal Alert regarding the decision by the Appellate Division, First Department to reverse a jury verdict and dismiss the complaint in Kang Kim v. City of New York, a roadway design case that Mr. Orenstein handled at trial.
Professional & Community Activities
Mr. Orenstein is a member of the Defense Research Institute and the American Bar Association. Mr. Orenstein has lectured in the area of legal ethics and was an instructor for the Trial Ethics Seminar for the Tort Division Trial Training. He has also served as a faculty member of the PLI Municipal Law Institute in 2001, and was an instructor for the Jury Selection Seminar for the Trial Advocacy Training Program in 2000. Mr. Orenstein also published the article, “Increased liability from Emergency Action Plans,” in two parts in the August 2007 editions of the New York Real Estate Journal. The article discussed the requirements of the New York City Office Building Emergency Action Plan rule, which took effect on December 31, 2006. He is also a co-author of the following articles: "PCBs from A to Z: A Re-Emerging Toxic Tort Concern," DRI, For the Defense, (January 2012), and “PCBs: The inside story and what building owners and property managers must address,” New York Real Estate Journal (November 22, 2011). Mr. Orenstein is also a volunteer for the American Youth Soccer Organization.
