Mr. Trevvett is a member of the firm and practices in the Labor and Employment Law Practice Group. He also serves on the Educational Institutions, Health Care, and Municipalities and Quasi- Governmental Agencies Industry Teams. He is co-leader of the Emergency Medical Services and Fire Protection Industry Team. Selected as one of the Best Lawyers in Americaand listed in New York Super Lawyers,Mr. Trevvett represents clients in both the public and private sector, focusing his legal practice on providing counsel to employers in all areas of labor and employee relations; defending employment discrimination claims and Department of Labor matters of all types; representing employers in National Labor Relations Board proceedings; negotiating collective bargaining agreements; arbitrating grievances; reviewing, revising, and developing employee handbooks and policies; drafting employment agreements; training managers in sexual harassment and other workplace issues; providing day‑to‑day guidance and advice to human resources managers on variety of employee relations concerns including Family and Medical Leave Act, Americans with Disabilities Act, ERISA, wage and hour law, progressive discipline and discharge, drug and alcohol testing, union avoidance, and unemployment insurance benefits. Representative cases include:
- Flanigan v. Cocco (New York State Division of Human Rights; 2005): Successfully defended landlord in an age-based housing discrimination claim.
- Watt v. Richardson (New York Appellate Division; 2004): Successfully defended Greece-Ridge Exempt Firemen Association against a union claim seeking payment of all 2% fire insurance monies received by the association.
- Scahill v. Greece Central School District (NY Court of Appeals; 2004): Obtained unanimous reversal of Appellate Division and reinstatement of the Greece Central School District’s determination to terminate an employee for misconduct.
- CSEA v. Bath Municipal Utilities Commission (NY Public Employment Relations Board; 2004): Obtained reversal of an ALJ decision finding that certain titles sought to be placed by CSEA in its existing bargaining unit were supervisory employees with significant supervisory duties, thus keeping those employees out of the union.
- Matter of Pierce v. Monroe 2 BOCES (NY Appellate Division; 2004): Successfully defended the Monroe 2 BOCES’ dismissal of teacher claiming tenure by estoppel.
- Cooper v. John D. Brush & Co. (US District Court; 2003): Summary judgment obtained for employer in a racial and hostile work environment harassment case.
- McNamara v. Mills (NY Supreme Court; 2002): Successfully defended challenge to decision of the Commissioner of Education that upheld the West Irondequoit Central School District’s dismissal of the employee.
- Alfieri v. Sysco Food Services (US District Court; 2001): Summary judgment obtained for employer in a sex discrimination case.
- Dana v. Kelly Services (US District Court; 2000): Summary judgment obtained for employer in a sexual harassment case.
- Matter of Aeneas McDonald PBA v. City of Geneva (NY Court of Appeals; 1998): Successfully defended decision by the city to change the level of health insurance benefits for retirees.
Professional & Community Activities
Mr. Trevvett is a member of the New York State Bar Association. He is also a member of the F.F. Thompson Health System Inc. Pension Subcommittee and treasurer of Cub Scout Pack 32.
