Kevin P. Ryan

Mr. Ryan is an associate of the firm and a member of the Construction and Surety Law and Business and Commercial Litigation Practice Groups.  He also serves on the Educational Institutions Industry Team.  His practice is focused on all aspects of construction law, particularly the representation of owners, contractors, and sub-contractors in dispute resolution through arbitration, mediation or litigation.  An experienced trial attorney, Mr. Ryan has successfully represented clients and obtained favorable verdicts in both jury and non-jury trials.  Mr. Ryan has represented contractors and manufacturing companies with regard to contract disputes with local, state and federal governments.  He has also successfully represented clients in Article 78 proceedings against municipalities relating to development projects and has represented municipalities in the prosecution of zoning violations and defendant claims brought against the municipalities and their officials.

Mr. Ryan is also experienced in matters arising out of the New York State Election Law having successfully preserved a political candidate’s appearance on a ballot line against a challenge to nominating petitions.  

The following cases are representative of the matters in which Mr. Ryan acted as chief legal counsel or as co-counsel.

• Successfully defended the owner of a construction project against a lien claim brought by a sub-contractor by establishing that the prime contractor was owed no further payment on the project;
• Successfully represented a school district in dispute with an asbestos abetment contractor relating to issues of non-performance and a claim of non-payment;
• Obtained a settlement in excess of $1,000,000 on behalf of a munitions manufacturer whose contract with the United States Department of the Army was wrongfully terminated;
• Obtained a favorable arbitration award on behalf of a contractor seeking payment from a local housing authority as a result of defective contract specifications and differing site conditions;
• Successfully represented sanitation contractor with regard to the challenge of an award of a municipal contract.
