Teresa Bair

Ms. Bair is a member of the firm. She practices in the Business and Commercial Litigation, Construction and Surety Law, Real Property Valuation Litigation, and Intellectual Property Law, and Insurance Litigation and Product Liability Defense Practice Groups. She focuses her legal practice on commercial disputes and intellectual property matters. Ms. Bair has conducted numerous trials to verdict in state and federal courts and dozens of successful mediations and arbitrations.
Representative cases include:
- Palladian Health v. Summer Street Capital (NYS Supreme Court, Erie County, 2012, and American Arbitration Association, Buffalo, NY, 2011): Counsel for Palladian Health in various claims alleging breach by private equity investor of financing and recapitalization obligations.
- Jaccard Corp v. TNI Packaging (American Arbitration Association, Chicago, Ill, 2012): Counsel for plaintiff in claim for breach of contract relating to the purchase of a business, resulting in award of approximately $800,000.
- Jaccard Corp v. Chef Master, Inc. (United States District Court, Western District of New York, 2011): Counsel for plaintiff in claim for trade dress infringement resulting in a settlement of $700,000 and defendant's withdrawal of accused products from the market.
- Wehle v. JPMorgan Chase (NYS Surrogate Court, Monroe County 2011): Counsel for JPMC in various trust accounting claims alleging breach of fiduciary duty relating to the investment and management of trust assets.
- Chapin v. JPMorgan Chase (NYS Surrogate Court 2011): Counsel for JPMorgan Chase in trust accounting claims alleging breach of fiduciary duty relating to the investment and management of trust assets.
- DigiTelcom v. Tele2 (International Centre for Dispute Resolution, 2010): Counsel for telecommunications developer in claims for breach of agreements relating to expansion of Russian wireless telephony networks.
- CBORD v. JSA Technologies, Inc. (NYS Supreme Court, 2010): Counsel for software development company in claims of breach of contract and tortious interference regarding alleged software pirating.
- Hoffend & Sons v. Daktronics (NYS Supreme Court, 2010): Plaintiff’s counsel in multi-million dollar claim for breach of contract following sale of company to defendant.
- New York State Urban Development Corp. d/b/a Empire State Development Corp. (NYS Supreme Court, 2010): Four week trial representing New York state agency in $60MM claim in contested valuation proceeding regarding property condemnation under State's compact with Seneca Nation of Indians.
- TNI Packaging, Inc. v. Jaccard Holdings, LLC (Illinois Circuit Court, 2010): Counsel for Jaccard in multi-million dollar claims for breach of contract regarding operation of new business venture.
- Jaccard Corp. v. Keystone Mfg. (U.S. District Court, WDNY, 2008): Plaintiff's counsel in two week jury trial for claim of trade dress infringement resulting in substantial cash payment and world-wide injunction for plaintiff.
- Superior Group v. Lawson Software (NYS Supreme Court, 2008): Substantial cash settlement in claim for fraud in the inducement of software contract.
- Proma, Ltd. v. Pefley Oil and Gas, Inc. (NYS Supreme Court, 2008): Counsel for oil and gas company in claims of breach of contract relating to royalties.
- Sui Juris, Inc. v. Trans Union Settlement Solutions, Inc. (U.S. District Court, 2004): Multi-million dollar cash settlement for plaintiff in claims asserting fraud and breach of contract following sale of company.
- Quadax, Inc. v. University Radiology; Buffalo Ultrasound v. Quadax, Inc. (AAA, 2003): Counsel for medical billing company in successful prosecution and defense of claims for breach of contract.

Ms. Bair is a member of the Judiciary Committee of the Erie County Bar Association, Women’s Bar Association of the State of New York, and the Western New York Trial Lawyers Association. She is also a former member of the board of directors of the University of Buffalo’s Law Alumni Association
