The disclosure of confidential information in business can be extremely damaging. To lower the risk, organizations often ask people who receive this information, including employees, to sign non-disclosure agreements. But NDAs are notoriously difficult to enforce, as the litigation over the book by former National Security Adviser John Bolton showed recently. And so are other post-employment agreements such as non-competition and non-solicitation agreements.
