A $27 million judgment after three jury verdicts in favor of Greatbatch Ltd., a Buffalo-based medical device manufacturer and subsidiary of Integer Holdings Corporation, has been upheld by the U.S. Court of Appeals for the Federal Circuit. Greatbatch has been represented through this matter by the Intellectual Property Law Practice Group at Harris Beach PLLC.
The ruling came in a long-standing and vigorously disputed patent infringement case dating back more than seven years. The Appeals Court without comment let stand a 2019 verdict from a U.S. District Court jury in Delaware.
In the case, Greatbatch asserted patent infringement by AVX Corporation and AVX Filters Corporation on filtered feedthrough assemblies manufactured for Boston Scientific Corp. The infringed patents involved innovative filtering solutions to eliminate the risk that electromagnetic noise generated by radio waves, cell phones and Wi-Fi networks could interfere with the operation of implanted medical devices such as pacemakers and implanted cardioversion defibrillators.
The judgment covered lost profits on lost sales, royalties, and damages from price erosion in the marketplace.
