Harris Beach Elects Six Attorneys as Partners

Harris Beach attorneys Eric J. Bach, William Q. Lowe, John A. Mancuso, Steven P. Nonkes, Joshua A. Penner and Marnie E. Smith were elected partners of the firm effective January 1, 2017.
Eric J. Bach focuses his practice on not-for-profit organizations and the health care industry. He advises institutional providers, insurers, and municipalities in matters involving health care operations and regulatory compliance. Eric has significant experience counseling clients in matters relating to Medicare and Medicaid reimbursement, fraud and abuse compliance, and in representing tax-exempt organizations in matters before the Internal Revenue Service. Eric received his JD, magna cum laude, from Albany Law School in 2009 and his BA from the University of Rochester in 2005.
William Q. Lowe advises public and private employers in labor relations matters including collective bargaining negotiations, labor arbitrations, employee discipline issues, leaves of absence and union organizing. He defends clients in employment litigation matters, including disputes over employment contracts, non-compete agreements, wage and hour claims, and employment discrimination claims. Bill was named to the Upstate New York Super Lawyers Rising Stars list in 2015 and 2016. In addition to his legal work, he serves as a consultant on the Affordable Care Act through the firm’s non-legal subsidiary, HB Solutions*. He received his JD in 2009 from Albany Law School and his BA in 2006 from SUNY at Stony Brook.
John A. Mancuso focuses his practice on commercial real estate, civil litigation, environmental and municipal law, including zoning, development, land use and reviews under the New York State Environmental Quality Review Act (SEQRA). John also counsels clients concerning title insurance claims, real estate title matters and disputes, property rights and boundary disputes, lakefront boundary and access issues, commercial landlord/tenant matters, and other related claims. John also has significant appellate litigation experience including filing briefs and arguing cases in the New York State appellate courts. John was named to the Upstate New York Super Lawyers Rising Stars list in 2014, 2015 and 2016 in the areas of Real Estate: Business, Civil Litigation: Defense, and Land Use/Zoning. He received his JD, summa cum laude, from Syracuse University College of Law in 2009 and his BA, cum laude, from Ithaca College in 2004.
Steven P. Nonkes focuses on intellectual property matters, including patent, trademark, copyright, and trade dress infringement actions. Prior to entering law school, he held engineering positions in software development, electronic circuit design, and fiber-optic design. Steve also handles general commercial litigation matters, including construction contract disputes, business contract disputes, government investigations, and federal and state appeals. Additionally, Steve handles OSHA matters involving investigations into construction accidents and construction site conditions. He was named an Up and Coming Attorney by The Daily Record and listed as an Upstate New York Super Lawyers Rising Star in 2016. Steve received his JD, magna cum laude, from Cornell Law School in 2009 and his BS, cum laude, from Rensselaer Polytechnic Institute in 1997.
Joshua A. Penner has a broad corporate law practice involving corporate formation and restructuring, lending and finance, mergers and acquisitions, capital formation, general commercial transactions and other transactional matters. He regularly advises financial institutions and borrowers in commercial and asset-based lending transactions, including advising lead financial institutions in large syndicated loan transactions. Josh also represents both buyers and sellers in asset and equity acquisitions and dispositions and has extensive experience drafting highly complex limited partnership and limited liability company agreements in the context of formation, restructuring, start-ups and joint ventures involving tax, regulatory and intellectual property considerations. Josh received his JD in 2006 from Columbia University School of Law and his BA, cum laude, from Harvard University in 2002.
Marnie E. Smith counsels school districts regarding matters involving students, employees, and boards of education. She represents school districts in arbitration proceedings, Section 3020-a and Section 75 hearings, as well as appeals to the Commissioner of Education. Marnie also advises private employers regarding issues such as employee discipline, wage and hour matters, and discrimination or harassment claims and investigations. She defends public and private employers in administrative proceedings before the Equal Employment Opportunity Commission, the New York State Division of Human Rights and the Department of Labor, as well as in state and federal courts. She was named to the Upstate New York Super Lawyers Rising Stars list in 2014, 2015 and 2016 in school and education law, employment and labor law, and e–discovery. Marnie received her JD, magna cum laude, from SUNY at Buffalo School of Law in 2009 and her BA, cum laude, from Union College in 2006.
