Attorneys Michael Condon, Emily Crowley, Michael Curti, Kelly Foss, Julian Modesti and Marina Plotkin have been elected partners of Harris Beach PLLC, effective Jan. 1, 2020.
Michael E. Condon advises clients on all phases of commercial real estate transactions, spanning from negotiation to closing. He represents developers, lenders and institutional and non-institutional investors in the acquisition, development, financing, construction, leasing, management and disposition of commercial real estate projects. He also counsels financial institutions on commercial loan transactions and businesses on a range of operational, organizational and strategic matters. Michael received his JD, cum laude, from Syracuse University College of Law in 2012.
Emily D. Crowley represents hospitals, health care providers, nursing homes, assisted living facilities and adult care homes. She advises clients on clinical operations, patient rights, risk management, regulatory compliance and other matters. She also defends clients in medical malpractice and negligence cases. Emily earned her JD, magna cum laude, from Albany Law School in 2011.
Michael V. Curti supports municipalities, public benefit corporations, special districts and local authorities with key aspects of economic development and land use projects throughout the Hudson Valley and on Long Island. Michael is a former corporation counsel for the City of Yonkers and general counsel of the Yonkers Public Schools, having shaped several of that city’s most significant and ambitious economic development projects. He earned his JD from St. John’s University School of Law in 2004.
Kelly S. Foss focuses on assisting clients in resolving complex commercial disputes. She has litigated cases in New York state and federal courts, which have included appeals to the Appellate Division, Fourth Department and to the Second Circuit Court of Appeals. Kelly has experience litigating contract disputes, disputes over ownership interests in closely-held businesses, disputes involving life settlements, breach of fiduciary duty, anti-compete clauses and business torts. Kelly received her JD, summa cum laude, from the University of California Hastings College of Law in 2012.
Julian B. Modesti is a commercial litigator whose practice encompasses shareholder disputes, leases, land-use matters, finance agreements, unfair competition, trade secrets and business torts. He is also the firm’s head litigator for trust and estate disputes in Surrogate’s courts. Julian handles appeals in state and federal courts on a wide variety of civil law issues and is frequently retained as a mediator. He earned his JD from Vermont Law School in 1994.
Marina Plotkin is a medical and life sciences pharmacist attorney whose real-world experience as a supervising pharmacist provides unique insights in the representation of pharmacies and the pharmaceutical industry. In addition to defending malpractice lawsuits, she handles responses to audits, inspections, subpoenas, and investigations and counsels pharmacy clients on regulatory and compliance obligations, opioid stewardship initiatives and proper interception of prescription red flags. She has extensive experience litigating product liability cases involving pharmaceuticals and medical devices. Marina graduated magna cum laude with her JD from Fordham University Law School in 2005.
