Partner Brian D. Ginsberg, a veteran appellate lawyer with experience litigating high-stakes appeals spanning a diverse array of industries and legal issues, has been appointed co-chair of Harris Beach’s national Appellate Practice Group. As Law360 and the New York Law Journal previously reported, Brian became co-chair in October 2023. He leads the group jointly with partner Svetlana K. Ivy.
Brian joined the firm in 2022 after serving in the Office of the New York State Solicitor General, the elite unit responsible for representing the State of New York in some of its most economically, politically, and socially significant appeals, including appeals in the U.S. Supreme Court. Brian’s appointment as co-chair makes Harris Beach one of a small number of firms in the entire country with an appellate practice led by an alumnus of that prestigious office. Before serving in the Solicitor General’s Office, Brian worked in the appellate practice groups of two multinational law firms. He has litigated hundreds of appeals in federal and state courts nationwide, and has personally presented more than 95 appellate oral arguments. Brian began his career as a law clerk to Chief Judge Michael A. Chagares of the U.S. Court of Appeals for the Third Circuit.
Since Brian’s arrival at the firm, clients across a broad range of industries have turned to him for their most important appellate matters. For one recent example, earlier this month, financial services firm Timetrics Risk tapped Brian to orally argue its “bet the company” appeal in the U.S. Court of Appeals for the Second Circuit, challenging a trial court’s dismissal of fraud, theft of trade secrets, and related claims that Timetrics had filed against certain of its former clients. Less than a week after oral argument, the appellate court issued a favorable decision reinstating key claims, in language that closely mirrored Brian’s presentation. Additionally, Brian led the briefing, and presented the winning oral argument, in a recent appeal reversing a monetary sanction that threatened to imperil a widely-used litigation defense strategy, as well as an appeal protecting a city’s decision to revise the term limits applicable to its elected officials. Brian also served as counsel of record on a brief that persuaded the U.S. Supreme Court to leave in place critical New York state legislative election reforms. Now, Brian is playing a leading role in an appeal of first impression on behalf of a waste management company involving the New York State Constitution’s “Environmental Rights Amendment,” which got underway last week.
