Harris Beach Educational Institutions Industry Team co-leader Jeffrey Weiss recently addressed school district requirements when a student with a disability is subjected to bullying during remote learning.
In “Respond Promptly to Disability-Based Harassment Claims During Online Learning” Jeffrey says, “The district has to make sure this is an environment where [the student] can be educated,” and goes on to discuss potential FAPE claims.
Weiss goes on to contribute to a list of steps districts should take when alerted to disability-based harassment during remote learning, including acting quickly, examining the connection between misconduct and school operations and building a record of the harassment.
