The Daily Record of Western New York has released its 2023 Power 20 List for Labor & Employment Law – and it again includes Partner Daniel J. Moore, leader of our Labor & Employment Law Practice Group. The Daily Record praised Dan and the 19 other lawyers for navigating the ever-changing laws and regulations that govern employment, which in recent years has included major concerns such as remote working policies, pay transparency, non-compete agreements, and more.
Dan offered that in the next 6 – 12 months employers will face many changes due to an employee-friendly National Labor Relations Board, Federal Trade Commission and New York State Department of Labor. For example, the FTC has proposed a rule prohibiting any use of non-compete agreements. In addition, the NLRB has significantly limited certain provisions in employment agreements, such as confidentiality and non-disparagement clauses, taking a lot of teeth out of them. “In New York State, the bar has been lowered for claims of harassment under the Human Rights Law, resulting in an increase in the number of cases going through the administrative process,” he said. “The sum of all these changes is that it is a lot easier for employees to bring claims.”
