Aubrey focuses her practice in the areas of energy law and appellate practice. As a member of the Firm’s Energy Industry Team, Aubrey advises clients on regulatory matters before the New York State Public Service Commission (PSC). Aubrey’s regulatory practice before the PSC includes representing transmission developers in securing Certificates of Environmental Compatibility and Public Need (CECPN) pursuant to Article VII of the Public Service Law (PSL), gas and electric corporations seeking to transfer or lease regulated assets and secure Certificates of Public Convenience and Necessity (CPCN), utilities in rate case proceedings, and corporate entities and real estate developers seeking to obtain approval to submeter electricity within multi-family residential buildings.
Aubrey is very familiar with the New York State Independent System Operator’s (NYISO) Public Policy Transmission Planning Process due to her representation of a developer that was selected to satisfy an identified Public Policy Transmission Need (PPTN). She also represented a nuclear decommissioning company in securing PSC approval for the first transfer of a retired nuclear-powered electric generation facility in New York. Aubrey’s practice also includes representing renewable energy developers as they seek to secure renewable energy credits from the New York State Energy Research and Development Authority (NYSERDA). Aubrey also regularly assists the Firm’s energy clients in civil litigation actions and Article 78 proceedings before trial courts.
Aubrey also focuses her practice on appeals, with a concentration on commercial transactions, contractual issues, and insurance matters before all four Appellate Divisions and the New York Court of Appeals. In this role, Aubrey is familiar with the appellate process and can advise clients on whether an appeal should be taken and identify appellate issues. Aubrey also composes motions for leave to appeal, drafts appellate briefs, and prepares for and delivers oral arguments.
