Frank provides all aspects of environmental, zoning, and land use legal services to companies, developers, and municipalities throughout the State of New York for a variety of projects.

Frank also handles all aspects of environmental and land use litigation before federal, state, and local courts including CERCLA cost recovery actions, NY petroleum spill claims, Article 78 proceedings regarding SEQRA and zoning matters, code enforcement cases, and other land use claims such as private lawsuits concerning lakeshore flooding. He defends clients in administrative proceedings before EPA and the NYS Department of Environmental Conservation concerning petroleum spills, hazardous waste cleanups, wetlands, and Clean Water Act, Clean Air Act, and Safe Drinking Water Act permitting issues. Frank was the Town Attorney for the Town of Rush, County of Monroe, for over 20 years, and is currently the Town Attorney for the Town of Victor, County of Ontario. Frank also assists various municipalities as special counsel on large-scale alternative energy projects, the consolidation of sewer and drainage districts, and landfill closures.

Representative Matters

  • Representation of Trammell Crow and Amazon in securing all of the zoning, SEQRA and public finance approvals and benefits for the construction of a 4.0 million square foot regional warehouse distribution facility, the largest of its kind in the Northeast region, in the Town of Clay, County of Onondaga, as well as a 2.8 million square foot warehouse facility in the Town of Gates, County of Monroe.
  • Provided Brownfield and SEQRA counsel for the City of Canandaigua North Shore Redevelopment Project, a significant multi-use lakefront project along the shores of Canandaigua Lake.
  • Provided zoning counsel to the developer of a medical cannabis grow facility in the County of Orange, as well as for various medical marijuana dispensaries located throughout the State of New York.
  • Provided Brownfields, SEQRA and zoning services to a client relating to the re-development of 100-year old manufacturing facility located in Buffalo, New York into a mixed-use site.
  • Provided Brownfields, SEQRA, and zoning services for a client developing a biomass fuel production facility on the former Griffiths Air Force Base located in Rome, New York.
  • Provided SEQRA and zoning services for Seneca County IDA regarding biomass fuel production on former Seneca Army base, as well as successfully defended approval of the project in an Article 78 proceeding.
  • Provided SEQRA and zoning compliance services for an 1,250 acre advanced technology manufacturing park located in the County of Genesee.
  • Assisted the City of Yonkers IDA in the Brownfields’ re-development of the former Austin Avenue landfill into a regional retail center.
  • Provided SEQRA assistance to Steuben County IDA on the review and approval of four wind farm developments located on approximately 100 square miles, and is currently representing the Steuben County IDA in an Article 10 review of proposed 242 megawatt wind farm project.
  • Provides on-going zoning due diligence for NextEra on acquisition of solar energy facilities.
  • Assisted developer of $300 million college campus extension in obtaining federal wetlands permits.
  • Assists the Town of Salina on a closure of its former landfill, and defending the Town in EPA cost recovery matters concerning the Onondaga Lake and Lower Ley Creek CERCLA sites.
  • Provides zoning code development for the Town of Richland and the Village of Pulaski.
  • Co-counsel for the Niagara County Refuse Disposal District providing counseling on regulatory matters associated with landfill operations, including expansion under the part 360 regulations, as well as supplementing closure of previously closed facilities.
  • Represents the developer of a mixed-use residential project along the banks of the New York State Canal System in the Village of Pittsford, County of Monroe.
  • Represents a developer on a Brownfield and land use project involving the construction of an affordable housing development in the Bronx Borough of the City of New York.
  • Represents an Erie County local development corporation in a brownfield project for a component of the former historical Bethlehem Steel Corporation facility located in Lackawanna, New York.
