Dan serves on national coordinating counsel teams defending manufacturers against complicated toxic tort and product liability claims. He also defends employers against claims for occupational injury, and is at the forefront of emerging law stemming from the COVID-19 pandemic.

The cases that Dan handles are complex, involving dozens of defendants and scientific evidence in specialized fields such as epidemiology, toxicology, and hematology.  Dan also participates on defense counsel committees that coordinate defense litigation strategy in chemical exposure cases nationwide.

Dan has extensive experience in trial advocacy and pre-trial litigation, including motions to exclude experts, dispositive motions, and expert discovery, and has achieved merits dismissal for numerous clients. He is particularly skilled in defending causation by applying scientific evidence and deconstructing expert opinion. Dan is also an experienced negotiator who is adept at using alternative dispute resolution where resolution would serve the client’s interests.

In addition, Dan represents clients in premises liability and medical malpractice litigation in courts throughout New York and Connecticut.

Representative Matters

  • Defends manufacturers and employers in state, federal, and administrative suits claiming chemical exposure led to fatal disease, obtaining dismissals on various grounds including lack of general causation.
  • Limits verdict exposure in product liability/toxic tort cases through targeted motion practice, including dispositive motions and other pre-trial motions.
  • Defends Fortune 500 retailers and restaurants in general liability claims pending in state and federal court, obtaining dismissals through summary judgment on essential elements like lack of notice, defect, or causation, and other targeted pre-trial motion practice.
  • Defends medical professionals and facilities against claims of medical malpractice and general negligence, including mass torts claims for alleged large-scale COVID-19 injury and death.
