Dale is the Leader of the Firm’s Business and Commercial Litigation Group and handles complex business disputes in state and federal courts across the country. He has experience in virtually every type of dispute that can arise in the business context, including breach of contract cases, partnership/joint venture disputes, business torts, antitrust claims, breach of fiduciary duty allegations, shareholder issues and commercial real estate disputes.  Dale is a former state prosecutor and represents clients in connection with investigations by state and federal enforcement agencies.  He has argued appellate cases before the New York State Court of Appeals and the United States Court of Appeals for the Second Circuit.

While in law school, Dale was associate editor of the Buffalo Environmental Law Journal. He is a member of the Golden Key and Pi Sigma Alpha National Honor Societies.

Representative Matters

  • Hanley v. Commercial Driving School, Inc., (Albany County, NY 2019): represented plaintiff in shareholder dispute and alleged breach of asset purchase agreement involving approximately $80 million in sale proceeds.
  • Lexon v. Federal Deposit Insurance Corporation, as receiver for First NBC Bank, New Orleans, LA (US District Court, Eastern District of Louisiana, 2018):  Counsel for Plaintiff alleging the FDIC’s improper repudiation of a $9.9 million Letter of Credit.
  • Marion County Tennessee v. Lexon (Twelfth Judicial District, Marion County Tennessee, 2018):  Counsel for Defendant in defense of $5 million bond claim related to a mountain top development project.
  • Lexon v. Futurenet Group, Inc.  (U.S. District Court, Eastern District of Michigan, 2017): Counsel to Plaintiff in action seeking to recover $10.6 million as a consequence of having executed performance bonds related to construction projects.
  • Negotiated nationally publicized settlement in 2013 with Federal Trade Commission and New York Attorney General to address antitrust concerns raised as a result of the consolidation of the only two hospitals in Utica, New York.
  • Insource Development Services v. HealthNow New York, Inc. and United Memorial Medical Center (U.S. District Court, Western District of New York, 2013): Counsel for the defendant in lawsuit alleging antitrust violations under the federal Sherman Antitrust Act and New York’s Donnelly Act.
  • Corporate Technologies, Inc. v. Onx LLC d/b/a Onx Enterprise Solutions (U.S. District Court, District of Massachusetts, 2013): Counsel for defendant in lawsuit alleging breach of non-solicitation and non-disclosure covenants.
  • NYSEG v. Wind Farm, Prattsburgh, (Steuben County, 2011): Represented defendant in defense of multi-million dollar claim alleging breach of an Inter-Connection Agreement related to wind farm project.
  • Excellus Health Plan v. Neulander (Supreme Court, Monroe County, 2011): Plaintiff’s counsel in claim for improper CPT Coding of medical services in violation of professional provider agreement.
  • Corning Incorporated v. RHI Monofrax Ltd. (Supreme Court, Steuben County, 2010): Counsel for respondent in special proceeding involving the alleged misappropriation of LCD glass technology by Chinese manufacturer.
  • ZVUE Corporation and eBaum’s World, Inc. v. Eric’s Universe, Inc. (Supreme Court, New York County, 2009): Defense of $20 million claim alleging breach of Asset Purchase Agreement and non-competition obligations related to nationally recognized entertainment website. Favorable settlement obtained following non-jury trial resulting in denial of plaintiff’s motion for injunctive relief.
  • Wolf Concept v. Eber Bros. Wine and Liquor, et. al. (U.S. District Court, Western District of New York, 2009): Counsel for defendants in lawsuit alleging violation of antitrust laws and various common law claims in connection with the distribution of spirits products in the New York City and Delaware markets.
  • Finger Lakes Racing Association v. New York Racing Association, Inc. (Supreme Court, Albany County, 2006): Member of plaintiff’s litigation team in special proceeding involving the interpretation of the New York State Racing Law, eventually resulting in a $2.8 million award for client.
