Whether the issues involve soil concerns, groundwater concerns, asbestos, reporting obligations, site access, the balancing and allocating of remedial costs and potential liabilities, financing, public infrastructure needs, or marketing an economic or community development opportunity, we take pride in our ability to find proven brownfield site solutions for our private and public sector clients.

We blend the New York State Brownfield Cleanup Program (BCP), the Environmental Restoration Program site access component, the Brownfield Opportunity Areas (BOA) planning process and often, municipal site acquisition and real property disposition strategies, with public finance incentive opportunities to help private parties and municipalities maximize redevelopment opportunities.

North Tonawanda Abandoned Factory

With the Remington Lofts on the Canal BCP Project, Harris Beach helped revitalize a former typewriter factory into a high-end, mixed-use space with 80 work/live lofts resulting in significant economic impact for North Tonawanda’s historic Erie Canal’s Gateway Harbor. The project involved BCP tax credits, Historic Tax Credits, IDA sales tax, mortgage recording tax and real property tax abatement, and  benefitted from several state grants to fill funding gaps.

Hudson River Waterfront

Harris Beach has assisted in several redevelopment initiatives focused on the waterfront in Hudson River communities. The projects utilized multiple benefit programs such as the BCP, urban renewal initiatives, condemnation and IDA financial assistance.

Canandaigua Lakefront

Harris Beach assisted a developer team to facilitate the development of a $120 million mixed-use project along the Canandaigua lakefront, known as Canandaigua North Shore. The BCP Volunteer helped clean up a 17-acre vacant site, and provided tax credits that were a critical component of the project’s overall financing. PILOT Increment Financing was utilized to cover certain funding gaps leading to successful reclamation and reuse of this once contaminated and blighted property.

Bethlehem Steel, Lackawanna, New York

Harris Beach counseled an Erie County Local Development Corporation in the acquisition of 240 acres of vacant and contaminated real property that once was the site of the historic Bethlehem Steel manufacturing facility. Risk allocation and tax credit allocation via use of the New York State Brownfield Cleanup Program between buyer and seller, the maintenance of BCP tax credits for future owners, as well as county bonding of roadways and site infrastructure are just a few of the strategies Harris Beach attorneys employed leading to the creation of one of the largest shovel ready, tri-modal (rail, roadway, port) industrial parks in New York state.
